Terms of Service

1. Acceptance of Terms

By accessing, browsing, registering for, or using TutionMat (“Service”, “Platform”, available at tutionmat.in), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you are registering on behalf of a coaching institute, school, or tuition center, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

TutionMat provides a cloud-based coaching institute operating system comprising:

• Student enrollment and batch management
• Attendance recording and automated WhatsApp parent alerts
• Tuition fee installment tracking, payment receipts, and UPI QR codes
• Online MCQ exams, offline marks recording, and AI question paper generation
• Downloadable branded PDF student rank cards and report cards
• Teacher, staff, student, and parent self-service web portals

3. Account Registration & Roles

To use TutionMat, you must create an account with accurate and complete information. The Platform supports distinct roles:

• Institute Owner (Admin): Has full master access to institute settings, subscription billing, fee revenue, and teacher accounts.
• Teacher / Staff: Access is restricted to assigned batches for marking attendance, recording test marks, and viewing homework. Staff cannot view institute fee revenue or bank accounts.
• Student / Parent: Self-service access to view their own attendance percentage, fee receipts, homework, and test rank cards.

You are responsible for safeguarding your login credentials and for all activities that occur under your account.

4. Free Trial, Subscriptions & Billing

14-Day Free Trial: New institutes may access TutionMat on a 14-day free trial with full features and without providing credit card details.

Paid Plans: After the trial period, continued use requires selecting an active paid tier (Starter Tutor, Growth Academy, or Mega Institute). Pricing is billed in Indian Rupees (INR) on a monthly or discounted annual basis.

Payment Methods: Payments are processed securely via UPI, Net Banking, Debit/Credit Cards, and certified payment gateways. All prices are exclusive of applicable GST unless stated otherwise.

Cancellation & Refunds: You may cancel your subscription at any time from your Institute Settings. You will retain access until the end of your current billing period. Due to immediate access to cloud resources, past subscription fees are non-refundable.

5. Data Ownership & Intellectual Property

Your Data Belongs to You: You retain 100% ownership of all student records, phone numbers, attendance logs, fee amounts, question papers, and study materials uploaded to TutionMat. You can export your data at any time.

TutionMat IP: The software, code, user interface, brand assets, and logos belong exclusively to TutionMat. You are granted a limited, non-exclusive, non-transferable license to use the service during your subscription.

6. Acceptable Use Policy

You agree not to:

• Use the service to send spam, unsolicited promotional messages, or abusive content
• Upload malicious code, viruses, or interfere with system integrity
• Attempt to reverse-engineer, decompile, or copy the software
• Upload copyrighted study materials without appropriate authorization
• Resell, sublicense, or rent access to TutionMat to unrelated third parties

7. WhatsApp Messaging & Third-Party Services

TutionMat facilitates WhatsApp notifications (attendance alerts, fee receipts) through standardized WhatsApp messaging protocols. You confirm that parents have provided their phone numbers for academic communication. TutionMat is not liable for carrier outages, temporary WhatsApp platform downtime, or incorrect recipient phone numbers entered by the institute.

8. Limitation of Liability

TutionMat is provided “AS IS” and “AS AVAILABLE”. While we maintain 99.9% target uptime with automated backups, we shall not be liable for indirect, incidental, or consequential damages resulting from downtime, internet interruptions, or third-party service failures. Our total liability shall not exceed the total amount paid by you in the preceding 3 months.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.
